By virtue of Part 1 of Article 1.5 of the Code of Administrative Offenses of the Russian Federation, a person is subject to administrative liability only for those administrative offenses in respect of which his guilt has been established.

In addition, article 4 of December 29, 2006 N 244-FZ contains the following definitions:
